Good afternoon,
I was just passed this email, regarding our sales department and was asked to respond. I work at Mondavi Resort as the Sales Office Manager and as far as I am aware the laws in Mexico are very different than the laws in the US and Canada. Our company policies do not let us interact with 3rd party clients as yourself in representing our members so therefore we cannot honor your request at this time. If you can send us a notarized power of attorney from the said clients then we will be happy to have all our communication through your company. Also as far as our attorneys have checked, you are not a registered law firm under any state we know of and there is no international order that we know of. Please feel free to send us all the necessary documentation to allow us to communicate only through you and we will gladly do so. This would include a notarized power of attorney, documentation that proves you have are registered as a law firm, and the documentation from a judge granting this so called international order....

Just  when you believe that you have seen it all, another VIP Client Shows us a new scam.  Ladies and gentlemen, we introduce you to "Mondavi Resort by QDM"  This is a brief summary of our investigation. This has been sent to all of the Private Investigators in Mexico who are also working with us.

This is a story of how one of our clients were taken advantage of by Mondavi Resort in  Puerto Vallarta Mexico. 
 

We were introduced to Jerry Forney (cell 01152 1322 2949746) who showed us around Mondavi Resort in  Puerto Vallarta Mexico.  and then presented the package to us. (Tried to Sell Us)   When we turned the initial proposal down they introduce us to John Kerrigan (cell 523-221-013096) who told us they had a foreclosure on a studio and the price was about $20,000.00.  
They promised they could sell our two timeshares that we already owned, one at the Sheraton Buganvilia for $17,645.00 and one at the Avalon Reef in Cancun for $28,470.00. 
They also told us they would rent our Studio for $1000.00 a week for the first 5 years and we would receive a check in January 2011.
They also told us we did not have the option to rescind the contract in 5 days because this was a foreclosure. 

We were on vacation and this was not a planned transaction but after hours and hours of dealing with Jerry Forney and John Kerrigan, we wearily agreed to the purchase in order to get out of there!  They told us that we would have to put down a deposit of $16,812.53.  In order to leave, We charged $7,026.00 to one credit card and $2,900.00 on another and charged a total of $6,886.53 on another card.  
It is interesting that the transactions were different because The  charge on my wifes card was to Mondavi Resort Spa and the charge on the other card was to Premium Resort Service.  Premium Resort Service  is the company authorized by law to sell the timeshares. 
We finally got out of this place, and knew that we could cancel, under the right of rescission.  That never happened!

After our vacation at home, we immediately started contacting  Mark Reyes in October at Premium Resort Services who I think is at 28 State Street, Boston MA. 02109.  Mark apparently left the company because when we called a Mr. Todd Strathman at answered.
He asked us to fax him the paperwork because Mark had taken it with him.  This was the point that we knew something was seriously wrong. 
He said he took over from Mark Reyes.  
This is the interesting part, Mark Reyes called us again and tried to tell us that he had a buyer for our timeshares but we would have to send him additional money for taxes. (AMERICA- THIS IS A SCAM) 
We told him we would not send any money untill money was placed in an Escrow Account.  He has not called back.  (Great Job Guys)
Mark Reyes told my wife to call Michael Novak at Time Share Advance Escrow () and he also wanted the paperwork which we never followed up because they wanted money up front.  We don't know if they are involved in Mondavi

We called Iris at Mondavi Customer Se) to explain to them that we did not have any more money to send unless they sold our timeshares so we could come up with the additional monies that they say we owe them.  (They say we owe them a large additional sum of money)1-866-978-8147

I met with my sister, who also dealt with these guys  in November and she told me that they received credit card charges that the company they went to took out in their names and charged approx. 14,000.00 dollars and sent the bills to my sister and husband. THE STOLE 14,000 from his sister... They got her to sign for a credit card that she never even knew about. (We are working with them also)  This is a SCAM!

I was shocked and went and looked at my contract and noticed they had only listed out down payment as $7,026.00. 
I could not understand so my wife called and spoke with John Kerrigan and asked him why the contract only indicated $7,026.00 as the down payment when we have the receipts that they charged against our credit cards was $16,812.53.  She asked him what happened to the other $10,000.00.  He did not explain and ended up hanging up on her.  We have called several times and talked to Iris who tells us they are going to call us back but nobody ever calls.  (Serious Illegal Conduct America)

So, now Western Capital is involved, and we are going to rip the hell out of this company and all of the people involved.  We sent out a memo to our Mexican Private Investigators and we are going to report everything we find LIVE.

All that we are going to say is that this client had better receive every penny paid to this company. They must be released from their contract and if you think for one second that we are going to simply go through PROFECO, you might want to think again.

America, We are on the case and you will not believe what we uncover.
Mondavi: Do your research, This post will be all over the world and we will NEVER pull it down. I HIGHLY suggest that you refund every dime within 24 hours and we will not pursue you for criminal charges.

Warning! Avoid Carlos Mondavi's Timeshare Scam

I'm posting this on behalf of my sister-in-law who just returned from a season in Puerto Vallarta, and has a horror story which could be a useful warning as to what is going on in the beautiful resort town.
My sister-in-law has been staying for years in Puerto Vallarta and rented apartments for the few months she would be there. The winter of 2008/09 she decided to look into longer-term housing, and found an ad in the Mano-a-mano for a real estate agent to take care of finding her a place: Carlos Mondavi.
Mondavi claimed to be a real-estate agent with years of experience in Puerto Vallarta specializing in condos for American and Canadians. When my sister-in-law met him, Mondavi said he would be able to get my sister-in-law into a place for the following winter (2009/10). He said he would need a retainer to find a place, which came to $1500 USD. She begrudgingly paid the amount, and was told that everything would be in order.
When she was getting ready to come back, my sister-in-law emailed Mondavi and he told her that he would be able to get her into a 'luxury suite in a famous hotel' which sounded up her alley. When she arrived, Mondavi was nowhere to be found. It took a couple weeks of asking questions before we were able to locate Mondavi. He told us he 'lost his phone' and therefore didn't have my sister-in-law's number, despite being in constant email contact.
Mondavi then had the gall to say that it was my sister-in-law's fault for not arranging things with him more clearly.. As if "Find me an apt in Nov." wasn't good enough.
My sister-in-law was forced to get a hotel room while Mondavi arranged the room (which should have been done ages ago) and then told her that he would be able to get her a room in the Grand Miramar Resort. Well, we checked it out and it was still under construction. We looked on here, saw the posts and told Mondavi NO WAY! He told us the place was a castle in Conchas Chinas and the condos were immaculate and brand-new.
Mondavi quoted my sister-in-law a ridiculously high price, and said would knock it down if she attended a timeshare presentation a month (!?!?!).
AND(!!) that she would have to lie on his behalf and say she was just visiting for the week.
It didnt' take long to figure out that Mondavi scammed my sister-in-law's money, had no intention of finding her a ligitimate place to live, and was trying to "OPC" her into seeing presentations so he could profit off her even further!!!
Please DO NOT get mixed up with Carlos Mondavi, he is a timeshare OPC who is only interested in committing fraud upon trusting foreigners.

Fraud in Puerto Vallarta

Thank you for your post.
My husband and I have been thinking about looking into longer-term stays in resorts also in Puerto Vallarta, but have heard many stories about these OPC's that will promise you a great deal on a wonderful new resort in a beautiful location, but never come through when it comes down to it.
This Carlos Mondavi sounds like just the person we were told to watch out for. Thank you again for the info and we shall spread the word that this Carlos Mondavi is not a man to do business with.
We are sorry for your sister-in-law loss and that she had to run into such a man as Carlos Mondavi.

are all over in Mexico. If you have been going there for a long time, ask for a referral from someone that you know. The manager at the resort you stay at. If you frequent a restaurant a lot and they know you ask the waiter. I would do a lot of reasearch before I handed over any money.

Aside from not paying any upfront fees to have anyone SELL your timeshare, we all need to be as careful not to pay to have anyone RENT one on our behalf.

So sorry for your sister in law's plight and thank you for making others aware of yet another predator to steer clear of.

Sadly it isn't the Sharks INthe water you have to look out for!!!

Thank-you for your post. This information can definitely serve to help those unfamiliar with the high-pressure and sneaky techniques some of the locals do on unsuspecting tourists.

Please be aware and cautious at all times while in Mexico.

Your reply was appreciated, thank you for your words of support. Mondavi and all these other crooks should really be investigated and sent off to some deserted island with a smoke monster (Too much Lost). They really hurt the reputation of such a beautiful location as Puerto Vallarta.

Mondavi Still at iT! Avoid the Scammer and Don't Get Fraud'd

I was just looking in the Mano-a-mano online edition and there it is.. another ad Mondavi posted trying to lure unsuspecting tourists into his shell-game.
I hope to warn people coming to Puerto Vallarta, especially the 'newbies' not familiar with the unscrupulous tactics some of these guys pull. Can you imagine if the resort's solicitors were regulated like back home or in Canada? I've been to Vail, Whistler, and other ski resort towns and not once was I hassled as much as the OPCs in Vallarta.
Mondavi's tactics to get my sister-in-law to lie at timeshare resort presentations in exchange for a reduction on an inflated rent is just bad news! I imagine the resort companies take fraud seriously and it would put my sister-in-law in jeopardy by lying to them.
Please let's get the word out about Carlos Mondavi and his brother Juan Paulo. Don't get scammed by these fraudulent brothers preying on naive tourists with a bait-and-switch resort deal that's too good to be true.

My husband and I attended a time presentation at Mondavi resorts with the lure of a $300 cash gift for attending. Instantly we felt pressured and intimidated. Besides that something just didn't seem right. Nothing was finished, they only could show me two completed rooms.After trying to leave several times finally they suggested that I use their new i-pad to check out the Mondavi website to prove that they were a fully operating resort. Well let me tell you, in 30 seconds I was able to pull up a bunch of scam warnings and called them out on it. My husband who was by then reading the online info asked them about Castles and Condos. To see the look on their faces was priceless. They couldn't get rid of us fast enough. Other presentation guests overhead us and started asking questions as well. We got our $300 us dollars and two free blankets rather quickly and were pushed out the doors. We can't thank you enough for the warnings. We feel lucky to have gotten out alive and not scammed by those crooks. We will spread the word as well and hope they are shut down.
