I found your site among many others that include people who have been ripped off by Westgate. We also didn't know about the ten-day cancellation period until it was way too late. We purchased ours in Orlando on 7/19/07. They sold us a unit that hadn't even been built yet, but we were told that we could always use a different one in the meantime. Later, we found out that you can use an alternate as long as you pay a hefty penalty for not using your own unit. We were also told that real estate is an "investment", but after my research online, I see that Westgate's owner (David Siegel) claims that they tell people it's a prepaid vacation. I'm sure he knows that his employees don't really tell people that. They also encourage you to post flyers offering $99 vacations. They say you can earn "trupoints" by putting your account number on these & getting credit when people redeem them. When you read through their fine print later, you see that you have to give them a list of names that will be using the $99 vacation or else you can't get credit for them. If you are putting these flyers up in random areas such as WalMart bulletin boards, how can you give Westgate a list of names? Obviously you can't, and they know it. Just another one of their scams. I noticed in one of your posted responses to somebody else that it could be considered fraud that Westgate shows on the sales paperwork that the deposit was paid in full on the sales date even though we had a payment plan on the deposit that went through October. Did you figure out a way to get the other people out of it? Have any attorneys perhaps come forward with plans for a class action suit against them? I would love to be part. I hate to think I gave them nearly 3 grand and got nothing for it.

An Open Letter To The Editor Of The Timeshare Beat (Not this site)

Dear Sir:

I hope you have the guts to print this letter.

I am an avid reader of your distorted timeshare report as are most of my colleagues in the timeshare industry as well as many thousands of current and potential timeshare owners. I, as the President of Westgate Resorts, am tired of being your whipping boy. I consider my company a very reputable one and take offense with your unfounded allegations. At first I took the attitude that any response would only give credibility to the ludicrous statements. But, now, after months of your continuous assaults, I feel I need to respond even if the response falls on deaf ears.

To begin with, we pride ourselves on being one of the pioneer timeshare companies. We also pride ourselves on the fact that in our 20-year history we have never failed to meet a payroll. Many of our employees have been with us from the very beginning, attesting to the fact that we treat our employees extremely well. In fact, our employees are among the highest paid people in our industry. With over 6,000 employees, there will always be a few disgruntled ones. When we are made aware of a problem, we are quick to resolve it. In most cases, we are able to.

It seems that you are hung up on reserve accounts and charge backs. Let me explain to you why this is not only necessary but critical to the survival of our industry as it currently exists. We sell anyone that can come up with a minimum 10% down payment, regardless of whether they are credit worthy or not. We do not run a credit check and, therefore, our salespeople have no credit rejects. The next day we give the salesman an advance of 50% of their commission, even before the customer's check has cleared the bank. Our experience has shown that many of our purchasers have an unsatisfactory credit history. Rather than reject a sale that a salesman has worked so hard to make because of credit, we accept everyone. Therefore, the reason for having charge backs. Once the purchaser has made six consecutive timely payments, the salesman is no longer on the hook for a charge back even though we have to receive many years of payments just to recover our cost of the sale. Many of our competitors do credit checks at the time of purchase and reject everyone that does not have a perfect credit history and, as a result, don't have to charge back their salespeople. Years ago, when we gave this option to our sales staff they overwhelmingly opted for the charge backs.

In the case of reserve accounts, when a salesperson leaves the company, they are responsible for all commission advances that were made to them until every one of the sales has made the six consecutive timely payments. In most cases, the charge backs exceed the amount of money due the salesperson when they leave. In some cases where they do not, we pay the balance to the salesperson once every sale has been cleared. I receive many letters from ex-salespeople requesting their reserves and, in each case, I have my payroll person figure up their account and contact them.

This is a very competitive business. In order to remain successful and to continue meeting all our obligations, we must run a tight ship and react to problems instantly. Sometimes this means firing or shifting personnel from resort to resort and whatever other things we deem necessary to be efficient. We don't need "The Timeshare Beat" second guessing us or taking pot shots at our company. We have good valid reasons for everything we do and we are not accountable to you.

Your "Timeshare Beat" could be an asset to the timeshare industry as a common denominator for all the timeshare resorts. It could be valuable as a way for our industry to stay on top of current news, employment opportunities, and even investment opportunities.

Unfortunately, you decided to be more like the "National Enquirer," "The Globe," and "The Star" and distribute rumors, half-truths and innuendoes in your paper rather than helpful and informative information. What you are doing is a disservice to the entire industry. While we have tried so hard to build up credibility with the public for our industry, you are doing us tremendous harm. When the public reads all of the garbage that you put in your paper, how could they possibly think that timesharing is the best way for families to vacation? They must have the impression after reading "The Timeshare Beat" that no one can hold a job, everyone is sleeping with everyone, every resort is going bankrupt and there are few credible people still around. This is far from the truth. The truth is that the timeshare industry is very much alive and prospering. We are one of the few industries that have consistently grown from year to year. With the entry of Disney, Marriott, Hilton, Hyatt, Four Seasons, Ritz-Carlton, Starwood, Wyndham and, of course, Westgate Resorts, the industry has never enjoyed higher credibility than it does today, in spite of your muck raking commentaries. Our industry employs millions of good hard-working people from all walks of life and in every community across the country we create huge tax bases, support the local charities and create employment. Our owners come year round to enjoy the resorts, pay taxes, spend money in the community and don't burden school systems, libraries or community functions.

I am a strong advocate of a national public relations campaign where every person will come in contact with positive articles on timesharing and learn about the benefits of owning a timeshare vacation villa. Your "Timeshare Beat" could go a long way in being the spokesman for our industry if you used journalistic responsibility.

Of course, these are only my views but I am sure that they are shared by all of my fellow developers as well.

Mr. Siegel:

Millions of people around the world have seen the video that is now on youtube showing the massive estate that you own and the abundance of wealth that you portray to have.

We have some questions for you that we have not been able to get answers on from your staff including but not limited to Barry W. Siegel, Tom Dugan, Mark Waltrip and David Crabtree

We are concerned about the thousands of people that have contacted our offices and in an open forum explain how they feel that they were abused by your company. They feel that they received nothing for their money, and they feel that the properties that they "bought into" are completely sub par, as opposed to what they were promised.

We refer you to The Westgate Vacation Villas Town Center , Buildings SSS and TP. We will be posting interior and exterior photos later for our readers, so that they are clear on these "5 Start Luxury Accommodations" that you provide.

Next, we are highly concerned about a lawsuit that your attorney Victor S. Kline of GREENSPOON MARDER, PA filed in Ocala County, Florida entitled : WESTGATE RESORTS, INC. VS DOE, JOHN Case 2008 CA 008314 OC

You will see that your company is claiming that some very senior employees in your Organization have been accused of serious torts:

You state" When an owner purchases a Timeshare Unit from Westgate, Westgate DOES NOT record any documents in the public records until the expiration of ten (10) days so that a purchaser HAS THE RIGHT to rescind ANY PURCHASE. After the ten (10) day rescission period expires, Westgate DOES NOT NOT RECORD ANY DOCUMENTS WHICH BEAR THE OWNERS HOME, BUSINESS ADDRESS, EMAIL ADDRESS OR PHONE NUMBER. An owner of a Westgate Timeshare unit is identified in the public records ONLY BY NAME and the address of the WESTGATE RESORT where the owner purchased an interest."

You further state" Defendant JOHN DOE, (Your employee(s) ) contacted Ana Garcia and Nicole Papanier, customers of Westgate who had already signed purchase and sale agreements. In the emails, JOHN DOE, made DISPARAGING COMMENTS about WESTGATE and advised Ana Garcia and Nicole Papanier how to rescind agreements with Plaintiff. The Emails were sent less than 10 days after Ana Garcia and Nicole Papanier had signed these their agreements with Westgate"

These comments in your public pleadings and our subsequent interviews with members of your staff (not Senior Management mentioned above) indicate that you have a policy of Prohibiting your employees from counseling the buyers whom enter into agreements with your company on how to follow their legal rights under State Code to Rescind any transaction that they make with your sales team "in the heat of the moment"

Further, we have been advised that you have a three step system to ensure that a customer DOES NOT CANCEL:

-Used to use Deja Wint and then in Nov 2007 switched to the MR system

" The contracts dept (appx 10 people entered - with only local data entered the information and the Deeding Department ( Villas 16-23 Employees ) One employee of the 23 personally entered One Million Dollars on books each month. This is typical. The industry avg cancel rate is 20-25 percent.

"We are told to do whatever it takes to keep "on the books" including ...

If contract is lapsed Past 10 days and if no full down payment or no first payment then all employees are PROHIBITED TO teach or inform victim purchasers how to to rescind contract.

In a search of all US County Court Records there is NO RECORD of ANY Foreclosure action against a buyer (victim) " We have been told time and time again that David Siegel will not foreclose, as he will simply keep the down payment and resell again and again and again. This is verified with the county recorders of the local jurisdictions.

All of this is also validated in the Deja Wint System/ MR System Data, and is used corporate wide to document all purchases with Westgate. The data in Deja Wint/ MR System Data, will clearly show that there is a common scheme or thread to defraud, as by reselling the same piece of property over and over, and by keeping all monies paid, by the purchasing victims, that the money will remain unclaimed and that the consumer will simply GIVE UP and that the BLANKET REFUSAL POLICY to refund money to buyers and to PROHIBIT employees from assisting the "least sophisticated consumers" in maintaining their rights will ensure continued profitability.

Think John Grisham's Movie 'The Rainmaker', in which he pits Rudy Baylor, a lawyer fresh out of law school, against Great Benefit Insurance and its lawyer Leo Drummond in a bad-faith claim lawsuit. What really made this book is the Black vs. Great Benefit case, and how an insurance company would bend over backwards to not get caught in its own lies.

This works because of the policy of the Deeding Department Agent not being able to file the legal deed , giving your company, Westgate Resorts, the ability to resell the same parcel again and and again.

"This is why we can provide credit to any warm body that shows, regardless of their financial situation, because we could care less if they pay"

Now, If no payments are made by victim for 6 months (on time ) then the paper can not be resold to banks. Siegel (sic) holds paper for six months and dumps it on the secondary market to the banks. "The aging is completely inaccurate, but nobody knows this, so the banks buy the high interest paper" (see Deja Wint/ MR System Data)

"We have three methods of collections internally"

1. Pending to Good --- in first 90 days if the victim buyer does not pay the down payment or any payment then the Pending to Good team will try to collect."

2. If No Success is made at this level, the the file is returned to the Original Closing Officer - if in 90 days a victim buyer is 10 days late on any payment then the Closing Officer must collect the payment himself or herself or "we do not get paid"

"Closing officers are required by David Siegel to have $50.00 to $150.00 per day WITHHELD from pay to cover high cancellation percentages."

"On all pending to good accounts percentage. 99 percent of officers loose 50 to 150 per day because of PENDING NUMBERS" (see future story)

3. Collections Department - Used to be called The Now Team - Customer Service is what they call it, but it is Collections.

We used to have "The Win Back Team: - the purpose of this team is to win back the lost business and to get accounts reactivated... to WIN BACK BUSINESS"

Based on the above comments and the lawsuit that you have filed wherein you are planning to depose a former employee, we at the timeshare chronicles are concerned about what YOUR OWN EMPLOYEES ARE SAYING. We are concerned about the failure to deal fairly with the public in not only Florida, but in Las Vegas. You can read our stories on the horror that our clients experienced in Las Vegas.

The bottom line is that we want answers. We want to know what you are intending to do as a corporation to deal with all of the names that have been entered into the Deja Wint System / MR System Data that are unhappy. We want to know how many people simply "lost" the money that they paid you and received nothing. We want to know WHY you prohibit your employees from helping your customers understand the laws of rescission. We want to know why The Mother in Law of your Senior Executive was hired, and why 6 qualified people were terminated. (story to come)

Mr. Siegel, this is not a game of smoke and mirrors.

This is real life and real people are loosing money because of the games that your company is accused of playing. The court records from around the country and the confidential settlement agreements executed between your company and employees, victims and even victims of sexual abuse are now available for the public.

The bottom line is .... WHY? Just for a big house?

Recently my widowed mother who is not in possession of all of her faculties was lured into purchasing a time share from Wyndham. With this time share she is supposed to receive some type of credit card in which whenever she uses it she recieves points to go towards her $1000 monthly payment for her time share. Additionally she was told that they would rent out her properties for her and that she would actually make money. My mother has attempted numerous phone calls to Wyndham and no one will return her calls. She has also sent them a certified letter requesting to get out of this contract. We have yet to hear from them. If my mother were to make the payments it would end up costing her 52k. This would virtually wipe out all of her retirement money that she has left. We have contacted the attorney general and the better business bureau and have not gotten very far. What can we do? Who should we attempt to contact at Wyndham? If we get an attorney, do we need a real estate attorney? Any information that you can provide would greatly be appreciated. Thank you

timeshare at the Flagship/Fanta, Atlantic City, Robert Paisola Responds

We have tried to sell our timeshare at the Flagship/Fanta, Atlantic City, NJ. They won't sell it nor will they foreclose for the fees we owe. We are paying the mortgage, but we have never used it. Playa del Sol Condominiums- One Hell of A Scam- Robert Paisola Investigates

My family and I vacationed in Puerto Vallarta, Mexico through a timeshare exchange to Playa del Sol Condominiums. When we got thru customs at the airport we were immediately taken to a counter where we were told we could arrange for transportation. Unfortunately by the time we got out of the airport I handed over $240 for discount tickets and a timeshare pitch at another resort.
When we arrived at our room we were very disappointed with our accommodations. It was a very small one bedroom. After our concierge showed us around she immediately wanted us to show her our coupon we got at the airport. The man at the airport told us not to show it to anyone because they will lie to us. She told me that if we met with this man that we would spend 4 to 6 hours there. She promised that if we changed to PDS that it would only last 90 minutes tops. After all was said and done we had changed to Playa Del Sol Grand for a timeshare presentation because she said they would also reimburse our $240.

At 9:00 AM we met Dianne Gayle (PDS Sales Rep) for breakfast with the only intention of getting our $240 back. We discussed fractional ownership, “secret inventories”, breakaway weeks, golf packages, triple lock downs and tax write offs for almost five hours with Ms. Gayle and her sales manager. Each time we said no they upped the ante. My wife and I were very tired. In a moment of weakness we asked the sales manager if he would consider moving our accommodations for the week from PDS Condos to PDS Grand. He said he could make that happen if we said yes. We did.

We met Brian MacDonald to review all the paperwork. At this point in time, I had serious reservations with this purchase. Mr. MacDonald called for Ms. Gayle and between the two of them tried again to reassure us that we could sell our week at our home resort and rent our breakaway weeks in order to pay for the timeshare. In fact, we were given two more breakaway weeks to rent in order for us to complete the deal. We were told we had five days to cancel the agreement. But if we did we would lose our $2,493 down payment. We walked out of the sales office around 5:00 PM. Can you say 8 HOURS?

After several uneasy days, my wife and I walked back into the sales office and found the sales manager who we had talked with on Tuesday. We told him that today was the fifth day and we wanted to cancel the agreement. He told us he would have to calculate the amount we would owe in order to cancel our membership. He said he would have to charge us for staying at PDS Grand. He asked us to speak with Mr. MacDonald again who basically told us the same thing he did on Tuesday. Near the end of our conversation, Ms. Gayle walked into Mr. MacDonald’s office. Mr. MacDonald exchanged with Ms. Gayle what seemed to be a very unpleasant glance. Ms. Gayle nervously began to try and convince us not to cancel our membership. I told them I wanted to see the figures the sales manager came up with. After a moment a women brought in a paper with the amount we would lose if we canceled our membership. The total amount was $4,637 for the down payment, closing costs, golf package, and PDS Grand upgrade charge. I told my wife that was ridiculous and that we couldn’t afford to lose that much money. Reluctantly we decided we had no choice but to keep our membership.

When we returned to the States, we read the “Membership Purchase Agreement”. The Playa del Sol sales representatives did not comply with Clause 9 that states “The member may cancel this agreement without penalty within five business days following the signing of the present agreement.., the club shall reimburse member with all amounts delivered as initial payment ...”

This was so illegal. We have retained the services of a local attorney to fend off the collection agencies and try and get our money back from Mexico. However, if there is any class action proceedings in the works please let us know. We would definitely be interested in participating. There is strength in numbers.

Westgate Resorts Scam- Robert Paisola Responds

Hello, I read a couple of things on allexperts that you wrote about Westgate.

Beyond my wishes, we purchased a TS with them in Orlando. Hmmm, I didn't want to, my husband always gets sold to easily. I was so frustrated with the wait cutting into our vacation (our older kids were waiting to go to Universal) that i just said fine we will do it to my spouse. We didn't cancel when we should have. (We only have 200 into it, thank God).

Anyhow, that was in Dec. 07. Now we have been in a chapter 13 bankruptcy, a strict budget. We really aren't suppose to be in contracts or have a mortgage. Couldn't we win getting out of this mortgage based on the grounds they were like "predatory lenders"? There is no way we are going to be able to make the payments. I guess my spouse was thinking our inheritance would come through our family soon, but it is not promising at all. Anyhow, I just think it is awful that they cut into our vacation with a 5 hour debate. I think it is convenient how they sold us one that was a "trade in" with a lower price -ha.

I knew this was a tactic. I thought it was also funny that the salesman said his son died in his arms and his wife almost died because of it. If you know of anything we can do to get out of this contract, please let me know. They told us that we are in it to stay no matter about the BR. They said we would have to go through the default process to even get out of it. Yeah, i bet that will be a lot of hassle; should I change my phone number? While I know there isn't anything they can do to me, my credit will just be worse I suppose. I was stupid for giving into my spouse due to frustration.

My name is Leila and I live in California.

In August 2006 me and my fiancé purchased a 6000 credit timeshare with Trendwest (which we dearly regret now).

First of all, when we were called to join a presentation we were told to say that we are married (which we are not) so we could qualify.

We understand that our contract states that we only have 7 days after the contract was signed to cancel. So, is this legal at all? Why shouldn't we be able to just cancel. I do not want my money back.

All I wish to do is to cancel now and stop making any further payments. They can keep the money I have been paying for over a year. I just cannot pay for this. I told them at the time of the purchase that I am a full-time student and that I just cannot afford this at all.

Unfortunately, the people were really pushy and made it sound very easy to pay for. Now, I am backed up with student loans and I cannot afford paying for a timeshare that I don't even use.

I have contacted Trendwest about this matter before and the only option that I was given, was to stop making payments and let it fall under collection and eventually, after seven years it would fall of my credit report. This is terrible! Is there any way out of this???
Please give me ANY advice you have! I do not know what else to do!

Beware, The Tahiti Village Strikes Again, By Robert Paisola

Dear Sir
I've been looking for help and came across your site. I'm not sure you can help me but, maybe, you can point me in the right direction. I apologize for the length of this email but, from reading your site, I know you ask for details.

In July of 2005 we met some friends visiting from England, in Las Vegas. Our hotel had a booth in the lobby offering free tickets to a show for sitting through an hour's presentation ... well, you know the story and you can guess what we went through during an 'hour's presentation' that lasted over 4 hours.

We had just put our home on the market and, because of the booming real estate market, thought it would sell immediately, we'd pay off the time share after the sale and be fine. You know what happened to the real estate market immediately thereafter. It's been 3 years and our home hasn't sold.

At the signing the notary, lawyer (whatever she was)... kept telling us not to worry about the high interest as we could 'always get a mortgage loan at a much less rate' once we got home. This, of course, turned out to be less than honest as no one (reputable) will lend on a time share.. but who knew that at the time? Nor can we sell it and get what we've paid for it or anything even close to that. There seems to be a glut of timeshares for sale. Turns out you can't sell it if it's not paid off. It's not like selling a home.... another less than honest sales pitch. It doesn't qualify as a second home either.

Caveat Emptor should be seared into one's brain but, alas, it is not and we pay the price for out naivete!

We've been paying our $435.95 monthly by credit card .. which is now maxed out and our yearly maintenance fees of $598.00. The deposit was $2,899.00.

In the meantime, my husband retired for health reasons, he will be 69 in March. I am 65 and also 'retired'.

We live on our social security which, in my case, is the bare minimum as I was a stay-at-home mom for most of our married life (46 years, 2 mos) and worked only occasionally. John also gets a small disability pension for his service in Viet-Nam and a $300.00 pension from the Post Office. Altogether we bring in about 2800.00 monthly.

Because of a second mortgage we took out to remodel the house and get it ready to sell, our mortgage payment is over $3,000.00 a month.

A friend recently hired John to help him with his business and he brings home +/- another 900.00 a month but we don't know how long this can go on and we're still 'in the hole' each month.

We've used up our entire life savings keeping us afloat until our home sells. Now we simply cannot afford to continue to pay on the time share but we don't know what to do about it. We were late paying last month and we've now missed Feb.'s payment. The collection calls come daily.

John did speak to someone who called and told her we couldn't afford to continue and we might just have to walk away from it and take the credit hits she threatened would follow. Then she started screaming at him, yelling 'Just who do you think you are, etc." and he hung up.

The daily calls have been so bad I'm afraid to answer the phone. Today a man identifing himself as 'an attorney for Consolidated' left a message on our answering machine demanding we contact him immediately. I know it will be an exercise in threats and intimidation and, frankly, neither of us can take it either physically or mentally. We are stressed out to the max. We just don't know what to do or who to turn to.

I'm hoping you will be able to offer some advice. I know we were foolish getting talked into the time share but we thought we'd be fine and the entire family would benefit in it's use. The two bedroom could be used by any or all of us. This was not to be however. The events I've described above have kept us from even using it once. One of my sons used it once but it wasn't 'free'. Fees still had to be paid. Guest fees, etc. Never really did understand that.

I realize that, at our age, we should have been smarter but...Can you offer any advice?

Tahiti Village and Consolidated Resorts Does it again, This time with the WRONG PERSON, Robert Paisola Reports

Dear Mr. Paisola,

I hope you can help me.

5 years ago, my husband and I got roped into buying a timeshare from Consolidated Resorts (Tahiti-Las Vegas) through many misrepresentations and high-pressured sales.

They threw in all kinds of extra incentives including 5 FREE TRIPS to our choice of locations worldwide. The catch - we had to buy the airfare THROUGH THEM - which cost more than the actual trips, we would later find out.

We bought a 1-bedroom, every other year for $8,995.

After we agreed on a price, they said they need a down payment of more than $2,000. We paid it.

2 days later we got cold feet and called and asked to cancel the sale. They said the person we had to talk to was not in but someone would call us back. No on called and when we called again once we returned home they said it was too late.

We financed it for 14.9 percent - BUT our sales people swore up and down that since this is a deeded property that we own, we can refinance through our own bank for a lower interest rate. Our bank, of course said no, since they have no recourse to repossess.

So, we have been paying our $160/month for 5 years... thinking we must be paid off soon, we called to check on our balance (we never get any statements) and they said we still owe $4,952. I asked how that is possible and they "mentioned" the $1.98 finance charge - PER DAY!!!! We have been paying $60 per month for finance charges per month on top of the interest!!!! They NEVER mentioned this as we would have never agreed.

And, they claim we owed $8,995 AFTER the down payment. This was NOT our original agreement.

I am beyond sick over this entire thing.

By the way, we have NEVER spent even a single night at Tahiti. The thought of it makes me want to cry. We also pay nearly $200 in maintenance fees every year.

Can you please offer advice as to what we can do???

I have lost more than a few nights sleep over this and I just want out.

Wyndham time-share...Harbour Lights in San Diego, Robert Paisola Investigates

I purchased (and I use the term loosely) a Wyndham time-share...Harbour Lights in San Diego - I have two contracts from the "closing" with two different purchase prices - two different "discounts" etc....
Long story short - this was a mistake and I am trying to understand how I can possibly be free of this. The complication is the ~$32,000 balance. Considering everything I have spent to date - and quite honestly just wishing (needing) to be free of this monthly payment - are there any options available to me short default, foreclosure....significant credit damage....

Wyndham Resorts Needs to look at this Case! Posted bt Robert Paisola

Mr. Paisola,
I am with Wyndham since Aug 07'. We have never used the package. I resigned from my job in Oct 07' to go onto work with another contract. Sad to say the contract was recinded and I was left without a job!

I spoke with Wyndham Resorts Reps countless times, they call my house at least 4 times a day and my cell phone too and explained to them that I never used the package and I would like them to let us out of the contract. I was informed that they couldnt do this because we didnt have the contract long enough.

Also, I have on 3 attempts asked that Wyndham stop trying to take monies out of my checking account, once in Dec 07', again Feb 08' and again Feb 12th, 08'. Each time they agreed and supposedly noted the account accordingly so that they would no longer draft monies from my checking account. I twice sent over a fax stating this to the supervisor to make this stop.

My checking account is in the red over $74.00. I was told by Wyndham that I would have to close out my checking account, so they couldnt get to it. I dont understand because my husband is footing all of the bills on his salary alone because I dont have a jobe and my credit and checking account is going down the tubes. I was told that my bank may contact ChexSystems due to repeated non-sufficient funds coming thru.

As I explained to Wyndham I cant take ANY vacation let alone theirs and we never used their package, so why cant they just drop us from this. If I used it I could understand but I dont understand them continuously making money off of someone whose bank account they have put into the red, ruined her credit and now tell me I have to close out my bank account I have had for years because they may not stop trying to get to my checking account.

PLEASE HELP ME!!! I am really stressing out and this is truly making me sick. What can I do to get my life back!! PLEASE HELP!!

Looks like The Krystal Cancun is following the Mexican Timeshare Fraud Path,

We would like to report that the Krystal Cancun is operating with unethical business practices, and what we believe to be fraudulent, given what we recently experienced earlier this year (May 2007). We would also solicit your help in helping to bring justice to the countless others that have been taken by their schemes by seeing to it that refunds are made and this practice stopped, as it only tarnishes this beautiful country.

Summary of complaint

1) Income misrepresentation.

During our sales presentation it was stated that we could easily resell our ownership, and by the time our 6 month same-as-cash financing would be due, have enough rental income to pay our investment off. Mr. Rafael Septien even put that in writing at a follow-up meeting where we had presented him with a request to cancel. During that meeting, he filed the rental agreement which they had failed to complete during the transaction, made written statement of the rental income promise within the six-month timeframe and also provided a letter from Emrem, the broker they were dealing with, claiming "high demand" and that the property, indeed, would have no problem renting. Because of these actions and a "sugar-coated gift" of extra weeks for our "inconvenience", we withdrew the cancellation.

Unfortunately the income promises turned out to be false. 8 months had passed and not a single rental took place, let alone the several that would have been required to pay off my contract as was promised. My same-as-cash financing with Bank of America came due during this time, so not wanting to destroy our credit record or pay high interest rates, we decided to pay this off. To make matters worse, after contacting the broker’s owner, we learned that Mr. Septien had no right to make any income promise or rental claims on their rental agreement form, as this was not their practice. He even implied this was not even their rental form and that had nothing on file in that regards. Not only is this unethical, it is fraudulent.

2) Lost week of timeshare.

We purchased in May 2007, with the first week of our contract effective also in 2007. Later that summer we paid our 2007 dues. We were told during our meeting that we had until the end of the year to deposit that 2007 week with RCI while we held out on the rental possibility. While waiting for clarification to that in a message sent to Daniel Diaz (Emrem) and Ray Rubino (Krystal) we decided to contact reservations, when we then learned our reservation window had expired. Sadly, when we had written Rubino and Diaz, we were still within our reservation window and they didn’t even show us the courtesy to inform us that we better make that reservation “straight away”.

When we called to complain, Mr. Septien promised to make it right by issuing us a bonus week. Unfortunately that "bonus" turned out "bogus" as it came with a "$200 string attached", hardly giving us the week we were entitled to! Just to show how wrong that was, we supposedly already had the benefit of unlimited weeks anywhere in the Krystal vacation club at a similar cost (something we also now believe to be untrue) so why he'd think that his bonus week was a bonus under those terms is beyond me.

Mr. Septien, and others serving him during this entire transaction, not only mislead us with false information, they lied to our faces by making untrue claims and promises. At this point we don't even have the confidence in the Krystal to think that anything we were told (or sold) was true, even to the point of claiming ownership of a legitimate timeshare!

This institution is being tarnished by people like Mr. Septien that are using a former football career and his "dream team promises" to completely mislead people with unethical business practices. He is not part of any "dream team" that I want to be associated with.

We have written formal letters to NH Krystal, Krystal International Vacation Club, Profeco, Bank of America and the Texas District Attorney. We had also filed complaints with various travel websites and thesqueakywheel.com and are now reaching out to NH Hoteles (corporate).

At this time, Bank of America has credited our account for the charges in response to our filing of the dispute. They initially pushed back, but when we provided them with the written evidence of Mr Septien’s income promise, they reconsidered their position and refunded us. Emrem, too, has issued us a refund for the rental fee, releasing them and us of any contractual obligation. The Krystal has not been cooperative thus far. They didn’t acknowledge our request for refund, which is why we approached Bank of America. They also have not acknowledged our request to cancel, even though Bank of America has reversed the charges.

It is our hope that our story will steer others away from this institution before they are drawn into their deceit. Some of you reading this may think we are “dumb tourists that were just caught up in the moment”. The truth is we are experienced timeshare owners in Colorado with several years of "home resort" usage and exchange. These people are slick, but that’s where their credibility ends. Save yourself some trouble and stay away from the Krystal Cancun!
